Terms of Service

Welcome to Ayiti Bèl. This platform is operated by JRICKSS Financial Services LLC, a company registered in New Jersey, United States ("we", "us", "Ayiti Bèl"). By using the site, submitting content, or purchasing a Patron subscription, you agree to these Terms.
1. What Ayiti Bèl is
Ayiti Bèl is a curated publishing platform that accepts submissions of verified, human-captured photographs and videos of Haiti, and publishes editorial articles built around that content. Every submission passes human review and automated verification before publication.
2. Who can use the platform
You may use Ayiti Bèl if you are at least 16 years old. You may contribute content only if you personally captured it, or if you hold written permission from the photographer. Submitting work that is not yours, or misrepresenting the origin of an image, terminates your account and voids any pending payment.

4. Contributor obligations
- You warrant that each submission was captured by a human with a camera or phone.
- You warrant that EXIF metadata has not been stripped, forged, or altered.
- You warrant that you have obtained any necessary consent from recognizable people in the image.
- You indemnify Ayiti Bèl against any claim arising from content you submitted.
5. Patron subscriptions and one-time purchases
Patron subscriptions renew monthly or annually at the price disclosed at purchase. Founding Patron is a one-time lifetime purchase ($49) limited to the first 200 buyers. Lifetime access remains active for the operational life of the platform. If Ayiti Bèl ceases operations, no further service is owed but no refunds are automatically issued beyond what the Refund Policy provides.
6. Acceptable use
You agree not to scrape, republish, or resell platform content without a license; not to attempt to bypass verification; and not to impersonate another contributor or photographer.
7. Termination
We may suspend or terminate any account that breaches these Terms. On termination we may retain records required for legal or financial compliance.
8. Governing law
These Terms are governed by the laws of the State of New Jersey, United States. Disputes will be resolved in the state or federal courts located in New Jersey, unless consumer law in your jurisdiction mandates otherwise.
Privacy Policy
Effective April 14, 2026
1. What we collect
- Account data: name, email, preferred language, role.
- Submission data: uploaded files, EXIF metadata (GPS, camera, timestamp), your caption and story.
- Payment data: processed by Stripe. We never store full card numbers.
- Usage data: pages viewed, referrer, device type, broad location (city-level).
2. How we use it
To verify submissions, publish content with credit, process payments, deliver newsletters, and improve the platform. We do not sell personal data. Period.

- Cloudflare R2 (media storage)
- Stripe (payments)
- Resend (email)
- Vercel (hosting)
- Anthropic (AI content analysis, no training on your data)
4. Your rights
You may request access, correction, export, or deletion of your data by emailing privacy@ayitibel.com. We respond within 30 days. GDPR and CCPA requests are honored globally.
5. Retention
We retain submissions as long as the associated article remains published, or until you request deletion. Financial records are retained 7 years for tax compliance.
Photographer License Agreement
Effective April 14, 2026 · Non-exclusive, revenue-sharing
1. You keep the copyright
You remain the sole copyright holder of every photograph and video you submit. Nothing in this agreement transfers ownership.
2. What you grant us
You grant Ayiti Bèl a non-exclusive, worldwide, royalty-free license to publish, translate, resize, and display your work on the Ayiti Bèl platform and in its direct editorial communications (newsletter, social media credited to you). The license lasts as long as the associated article remains published.
3. Revenue share
"Net" means gross revenue minus payment processor fees and direct delivery costs. We publish a transparency report every quarter showing total revenue, total paid to photographers, and platform operating costs.
4. Press syndication
Third-party press licensing (major news outlets, textbooks, documentaries) pays on a 70/30 photographer/platform split. No syndication occurs without your written approval per request.
5. Credit
Every publication credits you by your chosen name, with your bio and portfolio link if you provide them. Removal of credit is a breach by us and entitles you to terminate the license for that work.
6. Termination
You may request removal of any specific work at any time. We unpublish within 7 business days. Already-earned revenue share remains payable.
Refund Policy
Effective April 14, 2026
Founding Patron ($49 lifetime)
30-day full refund, no questions asked. Email hello@ayitibel.com with your order ID.
Platform failure guarantee
If Ayiti Bèl does not launch publicly by December 31, 2026 for any reason, we automatically refund all Founding Patron purchases in full, without requiring any action from you.
Monthly Patron
Cancel anytime. You retain access through the end of the paid period. Pro-rata refunds are not issued for monthly plans.
